• By purchasing and paying the buyer agrees to indemnify, defend, and hold Bay Promo, LLC, and its affiliates harmless from any cost or damages arising from the violation of any applicable sales of medical personal protective equipment including but not limited to: the negligent acts or omissions of any party. The buyer agrees that the products provided to them by Bay Promo, LLC, and its affiliates are non-refundable and are used at the discretion of the buyer. Bay Promo, LLC does not claim FDA certified products, any claims that are made are solely on the discretion of the manufacturer that produces the product. This is to avoid any misleading representation of the products that Bay Promo, LLC sells to its consumers. We claim no liability or responsibility in the products that we provide. By making the purchase, the customer assumes all responsibility of the products they order and receive.

• Buyer agrees to indemnify, defend and hold Bay Promo, LLC and the Client and their respective directors, officers, stockholders, partners, members, employees, and contractors harmless from and against any and all losses, liabilities, obligations, damages, deficiencies, taxes, penalties, actions, suits, proceedings, demands, assessments, orders, judgments, costs and expenses (including the reasonable fees, disbursements and expenses of attorneys, experts, and consultants) of any kind or nature whatsoever arising out of or relating to the buyer’s acts or omissions, negligence, willful misconduct, failure to comply with any law or regulation or breach of the terms of services Agreement. These indemnification obligations will survive termination or expiration past the end of the agreement.
